Discretionary Benefits Notification

On the 31 March 2010 the UCD Pension Scheme transferred to the National Pensions Reserve Fund under the Financial Measures (Miscellaneous Provisions) Act 2009.  A key feature of the Act states that, after the transfer order, any discretion in the management of member benefits such as the granting of added years is to be exercised jointly by the Minister for Education and Skills and the Minister for Finance. The University must now submit for formal approval all cases of added years to the Ministers (via the HEA).  

The discretion will be exercised at retirement only and the University does not have the power to confirm added years prior to the decision of the Ministers. 

There is a provision for any staff member, who has applied for retirement, and who believes they have been unfairly affected by an added years decision made by the Ministers, to appeal that decision.  The appeals process is the Superannuation Schemes in the Universities – Appeals Process to Higher Education Authority 

The outcome of this appeals process can, if necessary, be further appealed to the Pensions Ombudsman
