Third Annual Conference of the Irish Society of Comparative Law
The UCD School of Law hosted the Third Annual Conference of the Irish Society of Comparative Law. Forty-six papers were given on various areas of law in a comparative perspective. Delegates from France, the UK, Germany, Croatia, Italy, Romania, China, the US and Canada joined their Irish comparatist colleagues to make this two-day event a unique opportunity for rich discussions and exchanges. Much food for thought was given by the two keynote speakers, at the start, and at the close of the conference. Dr. Eric Descheemaeker, University of Edinburgh, UK, provided a fascinating account of the legal and etymological origins of the defence of truth as a principled approach in defamation in English law. He contrasted this approach with Roman law and looked at how Scots law and South African law have combined these two underlying theories in the fabric of their systems. He drew some conclusions of the "dangers of mixing it up", and reflected on the good of preserving the integrity of a chosen principled approach in a system. At the opposite end of the spectrum, Professor Patrick Glenn, McGill University, Quebec, advanced a theory of the "multi-valued turn" in comparative law, which would seek to find an "agreed middle" in legal solutions, rather than focusing on conflicts between legal solutions.
