Annual John M. Kelly Memorial Lecture
On Thursday, 7th October 2010, Professor Andrew Ashworth, the Vinerian Professor of English Law at the University of Oxford gave the 14th Annual John M. Kelly Memorial Lecture on the topic ‘Should Strict Criminal Liability be Removed from all Imprisonable Offences?’ In this lecture Professor Ashworth reviewed the arguments in favour of requiring proof of fault as a precondition of criminal liability, considered the significance of deprivation of liberty as a criminal sentence and enquired whether there are circumstances in which a person could properly be deprived of liberty without a showing of fault.
Amongst the audience were a number of judges from the High Court and Supreme Court as well as senior members of both branches of the profession and representatives from the Department of Justice & Law Reform, An Garda Síochána Ombudsman Commission and the office of the Director of Public Prosecutions. The School of Law was particularly glad to welcome members of the late John Kelly’s family to the event.
The lecture will be published in article form in the School’s flagship journal, The Irish Jurist.
